Period of election duty will be from the date of declaration of election till the result declaration
Chief Electoral Officer Shri Anupam Rajan has said that the Election Commission of India has made a provision of ex-gratia amount to the families of polling/security personnel in case of death or serious injuries while on election duty. This includes all personnel deployed on all types of election related duties, all security personnel of CAPFs, SAPS, State Police, Home Guards, any private person like drivers, cleaners etc. appointed for election duty and also BEL/ECIL engineers who are engaged in First Level Checking (FLC), EVM commissioning, polling day and counting day duty.
It has been clarified by the Commission that a person shall be deemed to be on election duty as soon as he leaves his residence/office to report for any election related work including training, unless and until he does not return to his residence/office after performing his duty. If any accident occurs during this period, it will be treated as an incident while on election duty.
For BEL/ECIL Engineers, the period of First Level Checking (FLC) duty and the period for which the officer is deputed for commissioning, polling/counting arrangements will be considered as election duty period.
Ex-gratia payment
During election duty if the death occurs due to terrorism or any violent act of anti-social elements like bomb blast, armed attack and Covid-19, then an ex-gratia amount of Rs 30 lakh will be given to the family of the employee. Apart from this, in case of death due to any other reason, an ex-gratia amount of Rs 15 lakh will be given. Rs 15 lakh will be given in case of permanent disability due to involvement of extremist or anti-social elements and Rs 7.5 lakh in case of permanent disability resulting from serious injury, such as loss of limb, eyesight, etc. The payment of ex-gratia amount will be in addition to the compensation already being paid by the Ministry of Home Affairs under its existing guidelines and any other compensation paid by the State Government or any employer. Payment of ex-gratia amount will be made promptly without any unnecessary delay.
Cashless treatment
The Commission has also directed to make arrangements for treatment in state-of-the-art hospitals for all such personnel involved in election duty who get injured or fall ill while on duty. To expedite treatment and avoid delays, cashless facilities can be provided to the victims by making arrangements/tie-ups with hospitals in advance till the announcement of elections.
